Damages and Liability Law

Damage has occurred quickly, but who pays for it? Liability under civil law is wide-ranging and often has its basis in the contract, but also in legal claims (traffic accident, product liability, etc.). Liability situations can affect anyone, arise in everyday professional and private situations, be due to sudden events, but also be based on a conscious decision (acceptance of a guarantee). Only examples are mentioned:

  • Expert liability
  • Purchase and work contract liability (in particular construction defects)
  • Rental damage
  • Delay damages
  • Consultant liability (tax consultants, auditors, lawyers)
  • Medical liability
  • Accidental damage
  • Product liability
  • Trademark/Copyright Infringement
  • Lost profit
  • Guarantee liability/loan security

Especially when dealing with banks, consumers often still have an inner shyness. This does not have to be the case, as the consumer's legal position vis-à-vis the bank is much stronger than is often expected. In particular, the legal changes in recent years based on European law have brought a significant improvement for the customer. Likewise, the case law of the highest courts has increasingly put the consumer in a more favorable position (keyword "immorality of spousal guarantees"). The importance of capital investment law has also increased considerably. The strong growth in the financial services industry is increasingly leading to cases in which investors have been inadequately informed or even misled about the crucial circumstances of the investment project. Investors often do not know that high demands are placed on providers of investment projects with regard to their obligation to provide information and advice. Therefore, lost money does not have to be irretrievably written off. Contact a competent legal partner if you have the impression that you have not been adequately informed about risks.
